Finding: Kirksville’s draft has a named staff preparer and shares distinctive wording with other jurisdictions. The records reviewed do not establish one original author, one common template, or a complete chain showing who supplied each clause to each city.

The city documents and the site summary have different authorship records.

Documented city preparer: Diane Albrecht, City Planner, is named as preparer and signs the September 16, 2026 staff report. The proposed-revisions PDF also names her in its author metadata. Metadata establishes a document-preparation lead, not original authorship of every clause.

The staff report says staff drafted the revisions using Planning and Zoning recommendations, Council discussions, additional research, City Attorney input and Missouri Municipal League input. It does not identify an original author for each provision.

Earlier wording and a documented sharing channel

Plano, Texas: Its September 2025 zoning compilation attributes the data-center definition to Ordinance 2010-10-15, case ZC2010-05. The definition includes an earlier, shorter version of the server-farm, telecom-hotel and telehouse co-location wording. This is an earlier provenance lead for part of the language, not proof that Plano wrote the full Missouri definition or supplied it to Kirksville.

Missouri Municipal League: Its 2024 conference program offered a session sharing Branson’s data-center zoning regulations. That documents a distribution avenue. It does not prove which materials Kirksville received or identify who first wrote the shared provisions.

New receipt, October 7, 2026: Branson’s original Bill 6472 / Ordinance 2024-0071 has now been obtained. It contains the expanded technology list (printed page 2), MENU definition and screening provisions (pages 3 and 6), and engineer-report wording (pages 6–7). Its final page states first reading August 1, 2024 and passage August 13, 2024. The preamble records a July 29 Planning Commission hearing.

Correction to the earlier receipt: The October 6 review’s earliest verified noise-report occurrence was the October 2024 amendment. The newly retrieved original moves the documented occurrence back to August 2024. It names the mayor and clerk in their approval and attestation roles but does not identify the original clause writer. Earlier occurrence still does not establish original authorship or direct transmission to Kirksville.

What remains in the research queue

  1. Original Branson ordinance obtained. Still retrieve July 2024 staff drafts, hearing packets and amendments to identify preparers and cited source material.
  2. Locate the MML presentation, handouts and any model ordinance or legal comments supplied to Kirksville.
  3. Trace Plano case ZC2010-05 and Ordinance 2010-10-15 to the original staff report and earlier definitions.
  4. Compare dated Kirksville drafts and documented City Attorney comments clause by clause; separate local additions from shared language.

Unknown: Who first wrote the expanded technology list, MENU definition and each protection; whether all jurisdictions used the same source; and which people changed specific clauses.
